ARTICLE 1: PURPOSE

The Terms of use (“ToU”) constitute the legal framework governing the use of the services of the www.edm.ch site (“the Site”). The present contract is concluded between the internet site manager, the association Enfants du Monde (the “Publisher”), and any natural or legal person wishing to access the site and its services (the “User”). The present ToU must be accepted by all Users. By accessing the site, our ToU are deemed accepted.

ARTICLE 3: SITE ACCESS

The Site provides free access to the following services:

  • information about the association and its programmes;
  • information about how you may support the association;
  • teaching material for teaching staff ;
  • publications released by the association (examples: news, yearly reports, quarterly newsletters);
  • images and video library;
  • vacancies;
  • subscription to the association’s newsletter;
  • on-line donation form;
  • documentation request form.

The Site is accessible everywhere and free of charge to any Users with access to the Internet. All fees granting access to services (software, IT equipment, internet connection, etc.), will be borne by the User.
The Publisher may interrupt or suspend the Site and its different services, in particular for maintenance purposes, without any obligation to give prior notice or justification.

ARTICLE 4: VERIFIED INFORMATION

The quality of the content published on the Site is of great importance to the Publisher, who will make every effort to verify that information available on the Site is accurate when it is published.
Whenever possible, the Publisher will disclose external information sources. Even if published information is deemed reliable, the Publisher does not vouch for, nor guarantee its accuracy or its completeness, and declines all responsibility for it.
The Site’s content may lead to third-party websites through hyperlinks. By clicking on such links, Users will leave the platform. The Publisher does not verify any third-party sites accessible through links provided on the Site and does not guarantee, under any circumstances, neither expressly nor tacitly, the quality of their content, nor that such content is relevant, accurate, comprehensive, up to date, available or lawful. The Publisher will not be held responsible for products, services, information, or any other content provided on such third-party sites linked to the Site. The same applies to third-party sites, which contain links leading to the Site.

ARTICLE 5: CHANGES TO THE SITE

The Publisher reserves the right to make changes to the Site, including the present ToU, the Data protection policy, information and services published on the Site, at any moment in time and without prior notice.

ARTICLE 6: INTELLECTUAL PROPERTY

The Site’s content, including but not limited to texts, trademarks, logos, graphs, pictures, videos, audio files, music, page layout, patterns, know-how, technologies, products, and procedures, belongs to the Publisher, or is used with the authorisation of its respective owners and is therefore protected by copyright, registered trademarks, patents and all other existing intellectual or industrial property rights under the applicable law (all rights reserved).
All other use of any content on the Site, whether total or partial and by any means, including copying, modifying, distributing, sharing, or releasing content, is strictly forbidden, save with the Publisher’s prior, written consent.
Exceptions under Swiss federal law on copyright and related rights are reserved, within the framework of the applicable legal provisions of Swiss Law.
The Publisher in no way guarantees nor declares that the use of the content on the Site will not be infringing upon the rights of others.

ARTICLE 7: LIABILITY

The User recognises and accepts that, to the extent permitted by the applicable rules and regulations, neither the Publisher (Enfants du Monde), nor its management, employees or agents, nor any other party involved in the creation, production or delivery of the Site will be held responsible in any way for direct or indirect damages, (even if such damages were known or could have been known to the Publisher), which may arise from accessing or using the Site.
The User will be solely responsible for documents downloaded or otherwise obtained while using our Site. The Publisher cannot be held liable for any damages to or virus which may affect the hardware or any other property belonging to the User, on account of accessing or using the Site, or downloading any material from the Site, or for any unauthorized interference or hacking of the IT systems.
The Publisher undertakes to employ all necessary means to ensure that data is kept secure and remains private. However, the Publisher does not guarantee total security.

ARTICLE 8: GATHERING PERSONAL DATA

Upon accessing the Site, Users will be asked to share personal information with the Publisher. Some information is automatically collected while Users navigate the Site (see Use of cookies below). Other information is provided manually by Users while they perform the following actions:

  • subscribing to the newsletter;
  • filling in forms on the Site;
  • requesting documentation;
  • becoming a member;
  • making a donation.

ARTICLE 9: USE OF COOKIES

With the purpose of enhancing the User’s experience, a cookie may be automatically installed on the User’s web browser.
Cookies are small files temporarily stored on the User’s hard drive. Such cookies are necessary to ensure accessibility to the Site and navigation through it. Such files do not carry and personal data and cannot be used to identify individuals.

ARTICLE 10: ONLINE PAYMENT

Users may make donations to the association Enfants du Monde by using the form available on the Site : https://don.edm.ch/en.
Online donations are processed through the Postfinance E-Payment module. This payment system is made up of several security barriers and complex encrypting processes, which guarantee the data’s security.
The Publisher does not keep any payment details (such as credit card numbers). Payment information is carefully processed, transmitted encrypted and not stored by the Publisher.
Please take note of the Data protection policy of service provider Postfinance.
Enfants du Monde accepts payment by MasterCard or Visa credit cards, and by PostFinance Card. Cancellation conditions of the credit card provider will apply. Furthermore, for payments by Visa or MasterCard, the banking institution will deduct a commission ranging from 2.3% to 3% of the donation amount as handling fee, with a minimum commission charge of CHF 0.22.
If Users choose the wrong donation amount, they may request total or partial reimbursement of the donation, within seven days from the payment date, by contacting the Publisher by email: info@edm.ch or by phone: +41 (0)22 798 88 81.

ARTICLE 11: DURATION AND APPLICABLE LAW

The present contract is valid indefinitely. It comes into effect and becomes legally binding for Users as soon as they start using the service.
The present ToU, access to the Site and use of the Site are governed exclusively by Swiss law.
Any ensuing disputes will come under the exclusive jurisdiction of the courts of the republic and canton of Geneva, except for possible appeals to the Federal Court (Tribunal fédéral), which are reserved.
